By accessing or using Ackuna, you agree to these Terms of Service and any policies referenced here. If you use Ackuna on behalf of an organization, you represent that you have authority to bind that organization.

If you do not agree to these terms, you may not use Ackuna.

Account Responsibilities

You are responsible for maintaining accurate account information, protecting credentials, managing organization access, and all activity under your account.

You must promptly notify us of unauthorized access or suspected security incidents involving your account.

Subscription & Billing

Ackuna may offer free, trial, manual, or paid plans. Plan limits, pricing, billing periods, and available features may vary.

You are responsible for fees, taxes, and charges associated with your selected plan. We may suspend or restrict access if payments fail or account limits are exceeded.

Acceptable Use Policy

You may not use Ackuna to send spam, unlawful content, malicious code, deceptive messages, abusive campaigns, or messages that violate recipient consent requirements.

You are responsible for your contacts, campaign content, unsubscribe compliance, sender identity, and adherence to applicable email, privacy, and marketing laws.

Intellectual Property

Translation Cloud LLC owns Ackuna, including software, design, systems, documentation, and related intellectual property. Customers retain ownership of their content and data.

You grant us the rights necessary to host, process, transmit, and display your content solely to provide and operate Ackuna.

Service Availability

We aim to operate Ackuna reliably, but we do not guarantee uninterrupted or error-free service. Maintenance, provider outages, network events, abuse mitigation, or force majeure may affect availability.

We may modify, suspend, or discontinue features when needed to improve, secure, or operate the service.

Limitation of Liability

To the maximum extent permitted by law, Translation Cloud LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities.

Our aggregate liability for claims relating to Ackuna will be limited to the amounts paid for the service during the period permitted by applicable law.

Termination

You may stop using Ackuna at any time. We may suspend or terminate access for violations of these terms, non-payment, security risks, abuse, legal requirements, or harmful platform activity.

After termination, access to data may be limited or unavailable, subject to retention, backup, legal, and operational requirements.

Governing Law

These terms are governed by the laws applicable to Translation Cloud LLC, without regard to conflict-of-law principles, unless mandatory law requires otherwise.

Any disputes will be handled in the appropriate courts or forums with jurisdiction over Translation Cloud LLC, unless otherwise required by law.
